1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Learned counsel for the petitioner submits that the petitioner in compliance of order dated 04.04.2024 had surrendered in time for seeking anticipatory bail, but then his criminal antecedent could not be verified as the report was not sent by the office of the Superintendent of Police, Rohtas. Despite, the learned trial court requesting the Superintendent of Police to send the criminal antecedent of the petitioner. Learned counsel for the petitioner further submits that since the criminal antecedent could not be received in time as such the bail bonds of the petitioner in absence of verification of his criminal

It is also submitted that for no fault of the petitioner, the petitioner is suffering as would also manifest from the order dated 16.05.2024 passed by the learned Exclusive Special Excise Court No.2-cum- Additional District and Sessions Judge, Rohtas at Sasaram.

3. Learned counsel for the petitioner submits that now the antecedent report of the petitioner has been received in the learned court below on 20.05.2024.

4. In view of the submissions made on behalf of the petitioner, in the event if the petitioner surrenders on or before 29.07.2024 his bail bonds shall be accepted on the same terms and conditions.

5. The modification application is allowed.
