JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Kotwali P.S. Case No. 94 of 2017 for the offence under sections 417, 418, 419, 420, 467, 468, 471, 475 and 120B of the Indian Penal Code. Counsel for the petitioner submits that petitioner was not named in the FIR. His name surfaced during the course of investigation. From the FIR, it appears that one Gyan Prakash who was running an institute allegedly imparting various courses including Bachelor of Fine Arts and on completion thereof, alleged certificates have been issued.

In this case, similarly circumstanced several coaccused have been granted bail as is evident from Annexure-2

Patna High Court Cr.Misc. No.36024 of 2017 (2) dt.10-08-2017 2/2 series and Annexure-3 series.

Considering the fact that large number of persons similarly circumstanced have been granted bail as is evident from Annexure-2 series and Annexure-3 series, I am inclined to enlarge the petitioner on bail on the ground of parity, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 94 of 2017 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses. (Anil Kumar Upadhyay, J) Ravi/- U T
