This is an application for bail in connection with Shakurabad P.S. Case No. 21 of 2010, corresponding to Sessions Trial No. 76 of 2017/544 of 2017, registered for the offences punishable under Sections 147, 148, 149, 307, 332, 353 of the Indian Penal Code and 25(1-B), 26, 27 & 35 of the Arms Act. Allegation as per FIR is that upon hearing sound of firing informant came at the place of occurrence and he was surrounded by accused persons armed with fire arms and petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that name of petitioner has been disclosed by co-accused who has been arrested at the spot and nothing has been recovered from his possession. Further submission is that he has no criminal antecedent and he is in custody since 5.6.2017.

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Shri Dharmendra Kumar Jaiswal, A.D.J.-II, Jehanabad, in connection with Sessions Trial No. 76 of 2017/544 of 2017, arising out of Shakurabad P.S.Case No. 21 of 2010, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
