Petitioner, in the present case, is seeking regular bail in connection with Kadwa P.S. Case No. 67 of 2020 registered for the offence under Section 366(A), 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that as per the prosecution story the daughter of the informant had gone to attend the call of nature but she did not return home. On search, the informant came to know that one Manti Mandal and others are involved in conspiracy of kidnapping of his daughter. They had sent selfie photo of the marriage of the daughter to him. Learned counsel submits that the victim girl is major and it is not a case of kidnapping rather she was in love affair with the petitioner, both of them have married and the victim

Patna High Court CR. MISC. No.39074 of 2020(3) dt.17-03-2021 2/2 girl has made her statement under Section 164 Cr.P.C. before the learned Magistrate in which she had admitted that she had solemnized marriage with the petitioner and that no one had kidnapped her.

Learned A.P.P. for the State has gone through the case diary and confirms to this Court that the victim girl is major and she has admitted to have married with the petitioner. In the given facts and circumstances of the case, the provisional bail granted to the petitioner vide order dated 09.02.2021 is confirmed. Petitioner shall be allowed to remain on the same bail bond.
