JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 06-02-2015 The only reason for non-consideration of the petitioner for regularization of service on Class-IV post is that he does not have the minimum requisite educational qualification, being eighth pass. If the minimum qualification has been laid down by the State in this regard, and admittedly the petitioner does not possess such a qualification, he may continue in the capacity of daily wager. He cannot be appointed by regularization under the Government without having the basic educational requirement. If the respondents have refused to consider his case on the above ground, the reasoning cannot be said to be discriminatory or arbitrary under whatever length of association of the petitioner under the respondents.
The writ application is, therefore, dismissed.
