JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. The prosecution case is of killing the sister of the informant after 21/2 years of the marriage for non-fulfillment of the dowry demand by strangulating her.

It is submitted by learned counsel for the petitioner that from bare perusal of the FIR, it appears that the case does not come within the purview of Section 304B of the IPC as there is no accusation of demand of dowry. Moreover, the informant has retracted from his initial version and filed a petition to that effect before the learned court below.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.45450 of 2015 (2) dt.24-09-2015 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ladaniya P.S. Case No. 102 of 2014 pending in the court of learned CJM, Madhubani. Accordingly, the application is disposed of.
