The petitioner is accused in connection with Sessions Trial No. 491 of 2016 arising out of Kahalgaon (Budhuchak) P.S. Case No. 02 of 2016 registered under sections 498(A), 304(B)/34 of the I.P.C. pending in the Court of 3rd Additional District and Sessions Judge, Bhagalpur.

Submission of learned counsel for the petitioner is that that earlier, prayer of the petitioner for bail was rejected by this Court on 18.04.2017 passed in Cr. Misc. No. 47682 of 2016 with direction to the trial Court to conclude the trial preferably within a period of six months.

On perusal of report of the 3rd Additional District and Sessions Judge, Bhagalpur, it appears that only I.O. and M.O.

Patna High Court Cr.Misc. No.55006 of 2018(3) dt.03-10-2018 2/2 are to be examined and the trial is in progress. In such view of the matter, prayer of the petitioner for bail is rejected for the present. However, Trial Court is directed to conclude the trial within a period of three months. If the trial is not concluded within the aforesaid period, petitioner may renew his prayer for bail.
