The petitioner seeks bail in a case registered for offences under Section 30 (a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 115 pouches each containing 200 ml of country-made liquor were recovered from the bag which was being carried by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 24.05.2017.
Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released
Patna High Court Cr.Misc. No.39171 of 2017(2) dt.19-08-2017 2/2 on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Lakhisarai in connection with Jhajha Rail P.S. Case No. 124 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
