The petitioner prays for anticipatory bail in a case registered under Sections 341, 323, 325 and 504 of the Indian Penal Code and Section 3 (i) (x) of the ST/SC (Prevention of Atrocities) Act.
It is submitted by learned counsel for the petitioner that a false case has been lodged by the informant as he himself was an accused on the basis of fardbayan of the petitioner recorded on 2.1.2015 at Sadar Hospital, Hajipur at 18 P.M., on the basis of which Sarai P.S. Case No. 4 of 2015 dated 8.1.2015 was instituted under Sections 342, 323, 308, 379, 504, 506 and 34 of the Indian Penal Code against the informant and others. It is further submitted that there is no allegation of any abuse by caste name in the first information report and thus the case is not
Patna High Court Cr.Misc. No.46855 of 2015 (2) dt.10-11-2015 covered by the provisions of SC/ST Act. It is also submitted that the petitioner does not have any criminal history. On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Sanjay Singh alias Sanjay Kumar Singh in the event of his arrest/surrender in the Court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Umesh Prasad, Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Sarai P.S. Case No.1 of 2015, subject to the other conditions as laid down under Section 438 (2) of the Cr.P.C. (Ramesh Kumar Datta, J) V.P.Sinha/- U
