The petitioner is in custody since 04.03.2017 in connection with Kothi P.S. Case No. 10 of 2017 for the offence registered under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that it is only on account of personal enmity that the present false and fabricated case has been lodged against him. It is further submitted that the informant is engaged in the business of smuggling of foreign liquor and when this petitioner came to know about the same, he was threatened and the present false case has been instituted against him. It is only because of this fact that as the petitioner had apprehended the cartoon of foreign liquor that the petitioner has been roped in.

Patna High Court Cr.Misc. No.52030 of 2017 (2) dt.10-11-2017 Considering the nature of allegation made and that the petitioner has already been custody for over six months, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Kothi P.S. Case No. 10 of 2017.
