Mr. Uma Nath Mishra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 02-07-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case is that from the house of co-accused Manoj Kumar liquor was recovered and allegation is that the petitioner was also involved in the business of liquor. Two other criminal antecedents of the petitioners of identical nature are there. FIR of those cases are attached with the supplementary affidavit filed by the petitioner. The petitioner is in custody since 29.08.2020.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after framing of the charge so that the trial may not hamper on furnishing bail

Patna High Court CR. MISC. No.8683 of 2021(3) dt.02-07-2021 2/2 bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Nasriganj P.S. Case No.107 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
