2. The petitioner is in custody in a case registered for the offence punishable under Sections 308(3), 308(4), 308(5) and 351(3) of the BNS 2023 read with Section 13 of the Unlawful Activities (Prevention) Act, Sections 18 and 20 of the Unlawful Activities (Prevention) Ordinance Act.
3. As per allegation in the FIR, 9 to 10 extremists members of Maoist organization who were armed with and were in police uniform, came to the construction site of the informant and handed over a letter to the guard of the company. In the said letter, there was intimation that further work was stopped by the organization and the construction work would commence only after talk with the Maoist organization.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.41507 of 2025(3) dt.10-09-2025 2/3 petitioner has falsely been implicated in this case. He next submits that petitioner is not named in the FIR and nothing incriminating material has been recovered from the possession of the petitioner for involvement of the present alleged occurrence. Petitioner has got clean antecedent as stated in para3 of the petition and he is in custody since 24.03.2025. He next submits that that similarly situated co-accused persons have already been granted bail by different Benches of this Court passed in Cr. Misc. Nos. 40102 of 2025, 43336 of 2025, 50822 of 2025 and 53326 of 2025.
5. Learned APP for the State opposes the prayer for regular bail of the petitioner.

In the light of the aforesaid facts as well as the fact that similarly situated co-accused persons have already been granted bail by different Benches of this Court, so let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Nabinagar P.S. Case No. 73 of 2025 with following conditions:- (i) One of the bailors will be a close relative of the petitioner.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the concerned Trial Court.
