Petitioner seeks bail in Kankarbagh p.S. Case No. 695 of 2016 for the offence punishable under Sections 447, 504, 506, 406, 420, 120(B) of the Indian Penal Code and Section 138 of the N.I. Act.

Allegation against the petitioner is that by inducement and misrepresentation, he took Rs. 90,00,000/- from the informant for making investment but after sometime, the informant realized that he has been cheated by the petitioner and wanted to get his money back then cheque of Rs. 2 Lakhs was given to the informant by the petitioner, but the same after being presented in the bank, got dishonoured and thereafter FIR

Patna High Court Cr.Misc. No.48992 of 2017(2) dt.17-10-2017 2/2 was instituted. On conclusion of investigation, the police submitted chargesheet against the accused and learned C.J.M. took cognizance of the offence punishable under Sections 447, 504, 506, 406, 420, 120(B) of the Indian Penal Code and Section 138 of the N.I. Act.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Kankarbagh P.S. Case No. 695 of 2016.
