JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Magadh Medical P.S. Case No. 11 of 2020 registered for the offences under Sections 382, 411, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the petitioner along with other co-accused were taking away the tractor of the informant when he was apprehended on chase by the informant and other villagers. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.39040 of 2020(2) dt.19-02-2021 2/2 petitioner would submits that petitioner was not apprehended by the police along with the tractor and nothing was recovered from the exclusive possession of the petitioner.

The petitioner is in custody since 15.01.2020. Considering the period under custody, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, shall be released on bail on furnishing bail bonds of Rs. 50,000/- (Rupees fifty thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Magadh Medical P.S. Case No. 11 of 2020.
