The petitioner is languishing in custody for the offence punishable under Sections 147, 148, 149, 341, 307, 326, 302, 504 and 506 of the Indian Penal Code and Sections 27 and 35 of the Arms Act.
The F.I.R. named accused persons variously armed attacked on the referred village. Others caused fire arm injury to some other person who died either at the spot or during course of treatment. The petitioner allegedly caused fire arm injury at the leg of Birendra. The doctor has found punctured wound at the leg of Birendra. Petitioner is in custody since 11.05.2020. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail for the present in connection with Konch P.S. Case No. 137 of 2020.
Patna High Court CR. MISC. No.38524 of 2020(4) dt.19-05-2021 2/2 Hence, prayer is refused.
However, the petitioner would be at liberty to renew prayer for bail, after framing of the charges, before the court below itself.
