The petitioner is languishing in custody for the offence punishable under Sections 25(1-b)26 of Arms Act. Allegation is that firearm was recovered from possession of the petitioner. Petitioner has got criminal antecedent.

Considering the facts aforesaid, prayer for bail was refused to the petitioner on 23.03.2021 with direction to the learned Trial Judge to expedite the trial.

It appears from the report of the learned Trial Judge that charges have already been framed on 07.04.2021. The case is triable by a Judicial Magistrate of 1st Class. Petitioner is ready to cooperate with the trial. Considering the period already undergone by the

No.52270 of 2021(3) dt.08-12-2021 2/2 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Goraul P.S. Case No. 228 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
