The petitioner seeks bail in connection with Lakhaura P.S. Case No. 112 of 2015, registered under Section 341, 384 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was twice refused by this Court on merit lastly on 08.02.2017 vide Criminal Miscellaneous No. 5021 of 2017 with a direction that if the trial of the petitioner is not concluded within six months, the petitioner would be at liberty to renew his prayer for bail. Further submission is that after passing of more than six months, the trial of the petitioner
Patna High Court Cr.Misc. No.49045 of 2017 (2) dt.17-01-2018 2/2 has not been concluded. The petitioner is in custody since 08.05.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-XIV, East Champaran, Motihari in connection with Lakhaura P.S. Case No. 112 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
