The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (A), 37, 41 and 45 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, huge quantity of foreign liquor were allegedly recovered from the Tata Safari vehicle of which the petitioner is said to be the driver. Petitioner claims that he is having clean antecedent and is in custody since 27.06.2017.

Considering the facts and the circumstances of the

Patna High Court Cr.Misc. No.40345 of 2017(2) dt.25-08-2017 2/2 case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Jamui in connection with Gidhaur (Luxmipur) P.S. Case No. 116 of 2017 with a condition that one of the bailors will be the resident of Bihar since the petitioner belongs to Jharkhand. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
