Having regard to the nature of allegation for offence under Sections 147, 149, 341, 324, 325, 379, 307 of the Indian Penal Code and that the allegation made against the petitioners in the First Information Report stands dully substantiated even from the supplementary injury report showing grievous injury after CT Scan of the head of the informant and that the injury subscribed by the petitioner in the First Information Report is also on the head of the petitioner, this Court is not inclined to grant privilege of anticipatory bail to either of them.

The submission that others have been granted anticipatory bail will also, therefore, make no difference in the case of the petitioners against whom a specific allegation of overt

Patna High Court Cr.Misc. No.46005 of 2015 (2) dt.03-11-2015 act has been substantiated.

For the reasons indicated above, the prayer for anticipatory bail of the petitioners, namely, Pappu Ram and Antu Ram @ Anthu Ram is hereby rejected.
