The petitioner apprehends his arrest in a case registered for the offence under Section 406 / 420 of the Indian Penal Code.

As per the prosecution case, the truck of the informant, which was parked in parking place, was fraudulently removed by the accused persons.

Petitioner is not named in the F.I.R. the name of petitioner transpired in this case during the course of investigation. Petitioner is not the owner of the vehicle and he has got no concern with the alleged vehicle.

Learned counsel for the State opposed the prayer for anticipatory bail and submitted that during the course of investigation it has come that petitioner claiming to be brother

Patna High Court CR. MISC. No.51642 of 2021(2) dt.28-06-2022 2/2 of the owner of the vehicle by showing some documents got released the vehicle in his favour from the parking. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
