JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner seeks pre-arrest bail in connection with Piprakothi P.S. Case No. 54 of 2016 registered for the offences punishable under Sections 302, 307/34 of the Indian Penal Code.

On behalf of the petitioner it is submitted that the petitioner has been falsely implicated in this case. From plain reading of First Information Report it reveals that against the petitioner there is no allegation for committing any overt act rather it has only been alleged that there appears some conspiracy of the petitioner also in the occurrence, the petitioner is a lady and as such she deserves sympathetic consideration, to which the learned

Patna High Court Cr.Misc. No.33633 of 2016 (2) dt.20-08-2016 2/2 A.P.P. fairly submits that against the petitioner there is no specific allegation.

In the facts and circumstances stated above, the petitioner in case of her arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Piprakothi P.S. Case No. 54 of 2016 subject to the conditions as laid down in section 438(2) of the Cr.P.C.
