JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2017 The appellant seeks regular bail in connection with Ahiyapur P.S. Case No. 99 of 2017, registered for offences punishable under Sections 376(A), 302/34 of the Indian Penal Code, Section 3(1)(W) of SC/ST Act and Section 4 of POCSO Act.
Allegation against the appellant is of kidnapping the minor daughter of the informant and committing rape on her and also of killing her.
It has been submitted on behalf of the appellant that he has falsely been implicated in this case and has no role to play in the said offence. Further he has no criminal antecedent and has been in judicial custody since 05.03.2017.
Learned Special P.P. opposed the prayer for bail.
