JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-10-2018 The petitioner is in custody since 26.06.2018 in connection with Alamganj P.S. Case No. 325 of 2018, registered for offences punishable under Section 30(a) of the Bihar Prohibitio of Excise Act, 2016.

Allegation against the petitioner is of recovery of more than 400 liters toddy from his tempo.

Submission of learned counsel for the petitioner is that the petitioner is a driver and he has no criminal antecedents and more over he remained in custody for more than four months. Heard learned A.P.P. also.

Having heard both sides and considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.53222 of 2018 (3) dt.31-10-2018 2/2 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-Excise, Patna, in connection with Alamganj P.S. Case No. 325 of 2018, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
