The petitioners are in custody in connection with Narpatganj (Bathnaha) P.S. Case No. 277 of 2019, corresponding to Special Case No. 614 of 2019 for the offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and they are in custody since 07.05.2019. He further submits that in the instant case 275 bottles each 100 ml. Wirof codeine syrup was seized but nothing was recovered from the conscious possession of the petitioners and he has no concern with the seized liquor.
