The petitioner is in custody in connection with Bhawanipur (Balia) P.S. Case No. 89 of 2016 (ST No. 88/2017) for the offences under Sections 302/34 of the Indian Penal Code. The allegation as per the Fardbeyan is that due to political reason the husband of the informant was eliminated by the petitioner and others. The petitioner along with others called the petitioner, took away him and later on he was killed. The petitioner is in custody since 24.3.2017. The other co-accused Mukesh Singh and Awadhesh Singh, who are involved in the killing of the husband of the informant, have

Patna High Court Cr.Misc. No.35595 of 2017 (2) dt.10-08-2017 2/2 already been granted bail on 28.6.2017 and 19.7.2017 by a coordinate Bench of this Court in Cr. Misc. No. 27137/2017 and Cr. Misc. No. 31538 of 2017.

Learned counsel for the petitioner submits that the case of the petitioner is on similar footing to the case of coaccused, who have been granted bail by this Court. Considering the fact that the allegation against the petitioner is similar to that of co-accused Mukesh Singh and Awadhesh Singh, who have been granted bail by this Court, on the ground of parity, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Purnea, District- Purnea or the successor Court in connection with Bhawanipur P.S. Case No. 89 of 2016, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
