Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No. 1006 of 2019 registered for offence punishable under sections 406, 420 of the Indian Penal Code and section 138 of the N.I. Act.
As per allegation, the informant is a contractor of electric zone of Bharat Sanchar Nigam Limited. The informant has a business in the name of Chandra Bhushan Electronics Firms. The petitioner, who is also a contractor, introduced

No.52056 of 2021(7) dt.17-01-2023 2/3 himself as Ram Narayan Yadav and Proprietor of Ram Narayan Electrical and he developed acquaintance with the informant and requested to give him Rs. 4,00,000/- as loan for participating in a tender. An agreement was prepared and the informant provided him the above-mentioned money, which was not returned to the informant. The petitioner issued cheques, which were dishonoured by the Bank.
The learned counsel for the petitioner has submitted that the entire allegation is false. The cheque book of the petitioner was lost in the year 2017, for that, he has made application to the Bank to stop payment. The notice was issued to the informant, but he did not appear despite the fact that notice has been received by him.
Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 1006 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.
Patna High Court CR. MISC. No.52056 of 2021(7) dt.17-01-2023 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
