The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

Ten passengers were robbed leading to the registration of the FIR against 15-16 unknown. The name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner that the petitioner had no information about the case as he is residing in Nepal. It is further submitted that the witnesses have not supported the prosecution case during the trial of co-

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It appears from the impugned order that the investigation has been concluded and the petitioner has been charge-sheeted.

This Court is not inclined to interfere since the case was instituted in 1998, let the learned court below consider the prayer for regular of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sugauli Rail P.S. Case No. 23 of 1998 (Sessions Trial No. 230 of 2003) pending in the court of learned Additional Sessions Judge-IInd, West Champaran at Bettiah.

With the aforesaid observation, this application is disposed of.
