Earlier prayer for bail of the petitioner was rejected by order dated 23.2.2017 passed in Cr.Misc.No.8026 of 2017 with an observation to renew his prayer for bail after framing of charge in this case.
Submission of learned counsel for the petitioner is that trial has not been concluded till date, as such, he may be granted bail and he will abide by any condition that may be imposed upon him by this Court.
Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that petitioner was given liberty to renew prayer for bail before the court but straightaway he has come to this Court for grant of bail.
Patna High Court Cr.Misc. No.43817 of 2017 (2) dt.13-09-2017 2/2 Having heard both sides and in view of facts and circumstances, the petitioner is directed to move first the court below, who will consider the materials on record and pass an appropriate order.
