The petitioner seeks bail in a case registered for offences punishable under sections 401, 272 and 273 of the Indian Penal Code and Sections 30 (a), 38 (ii) and 41 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 4 litres 320 Ml. of foreign liquor was recovered from a Tempo. Petitioner claims that she was neither arrested on spot nor was anything recovered from her possession rather she has been implicated in the present case on disclosure of her name by apprehended coaccused. Petitioner further claims that she is having clean antecedent and is in custody since 31.07.2018.

No.53666 of 2018(4) dt.08-10-2018 2/2 Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on her furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No. 927 of 2017. If the petitioner, after her release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of her bail bonds.
