JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). Directing the respondents authorities to name the Hospital in question after the name of the grand-father of the petitioner (Late) Bihari Sahu, as per the recital and stipulation in the deed of gift (Annx-1), executed by the father of the petitioner (Late Uchit Lal Sahu) in favour of the State of Bihar.

(ii). Directing the respondents authorities to follow and to obey the recitals made in the deed of gift (Annx-1) in true letter and spirit, and name the Hospital in question after the name of (Late) Bihari Sahu Hospital.

Holding and declaring that the respondentauthorities were bound to execute the agreement/ contract once reached between the donor and the donee (State of Bihar) and were also bound to consider the representations of the Petitioner (Annx-5) and ought to have redressed the grievances of the petitioner."

At the outset, the learned counsel for the RespondentState submits that the hospital in question has already been named as Bihari Sahu Additional Primary Health Centre, Bhagwatipur, Block Pandaul, District-Madhubani, i.e. after the name of the grand-father of the petitioner.

In view of the aforesaid, the learned counsel for the petitioner submits that though, at the moment, the petitioner is not having any grievance, but then a billboard displaying the aforesaid name of the Primary Health Centre should be placed at the Primary Health Centre in question, for which the petitioner is ready to bear the expenses.

The learned counsel for the Respondent-State submits that the Respondents do not have any objection if a billboard, as aforesaid is affixed at the Bihari Sahu Additional Primary Health Centre at the cost of the petitioner, as per the prevailing Rules. It is directed accordingly.
