JUSTICE HEMANT GUPTA ORAL ORDER 06-10-2016 The present is an application for grant of anticipatory bail under Section 438 of the Code of Criminal Procedure to the petitioner in respect of Gaunaha P.S. Case No. 22 of 2016 dated 12.02.2016 registered for the offences punishable under Sections 147, 148, 149, 323, 325, 448, 307 and 302 of the Indian Penal Code.

The allegation against the petitioner as per the F.I.R. is of hitting time and again on the head of the deceased Nasrina Khatoon, which led to her death.

Keeping in view the specific allegation made in the fardbayan against the petitioner, I do not find any case is made out for grant of anticipatory bail. Accordingly, the present application is dismissed.
