The petitioner seeks regular bail in connection with Siwan Mufassil P.S.Case No.343 of 2017 registered for offences punishable under Sections 272, 273, 308, 420 and Section 41(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 42 ltrs. of liquor.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. He has remained in custody since 2.8.2017. It is further submitted that the petitioner is accused in one more case but he is on bail in that case. Heard learned A.P.P. also.

Having heard both sides and in view of allegation this application is disposed of with direction that once

Patna High Court Cr.Misc. No.45499 of 2017 (2) dt.15-09-2017 the charge is framed or the petitioner completes three month more period in judicial custody, whichever is earlier, the learned court below shall release him in connection with Siwan Mufassil P.S.Case No.343 of 2017.

With the aforesaid observation, this application is disposed of.
