2. The allegation of the petitioner is that the respondent no. 06 has encroached upon public land and therefore the encroachment should be removed by the authorities.

3. The Circle Officer, Dhanarua, Patna is directed to consider the representation of the petitioner which has already been filed and the circle officer will initiate an encroachment proceeding in accordance with law under the Bihar Public Land Encroachment Act, 1956 against the respondent Nos. 05 and 06.

4. If such proceeding is initiated, the same shall be concluded by the Circle Officer, Dhanarua, Patna within three months from the date of receipt/communication of a copy of this order and he will decide the same after hearing all the concerned parties including the respondent Nos. 05 and 06.

5. With the aforesaid directions, this application is disposed of.

6. Let a copy of this order be communicated to the District Magistrate, Patna through FAX and e-Mail for its compliance forthwith.
