The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
A supplementary affidavit has been filed on behalf of the petitioners, which is on the record.
The petitioners are mother and younger brother of the husband of the victim of dowry death. There is general and omnibus allegation of demand of dowry and torture for the same. The husband is already in custody.
Submission is that there are growing tendency to
Patna High Court Cr.Misc. No.51974 of 2018(3) dt.26-11-2018 2/2 rope all the family members whenever some unnatural death occurs in the family. There is no witness of the occurrence. Further submission is that the Police has submitted Final Form in this case, however, the Magistrate had disagreed with the Police report.
Considering the facts of this case aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Angarghat Police Station Case No.22 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
