The petitioner has renewed his prayer for bail in connection with Sessions Trial No.196 of 2016 arising out of Jamalpur G.R.P. Case No.37 of 2013 registered under Sections 147, 148, 149, 323, 324, 326, 307, 379 and 302 of the Indian Penal Code and Sections 16 and 20 of the Unlawful Activities (Prevention) Act, 1967. His prayer for bail was rejected earlier by this Court vide order dated 19.05.2016 passed in Cr. Misc. No.21563 of 2016 with observation that in case the trial is not concluded within one year from the date of framing of charge, he would be at liberty to renew his prayer for bail before the court below itself.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.46654 of 2017 (3) dt.29-11-2017 2/2 that charge has been framed on 06.08.2016 and till date only four out of sixteen charge-sheet witnesses have been examined on behalf of the prosecution during trial. He submitted that there is no likelihood of conclusion of trial in near future. Learned counsel for the State has opposed the application for grant of bail to the petitioner. Considering the submissions made as also that the petitioner is in custody since 16.12.2015, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-1, Lakhisarai in connection with Sessions Trial No.196 of 2016 arising out of Jamalpur G.R.P.
