JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-02-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Koilwer P.S. Case No. 352 of 2020 for the offence under Sections 25(1-b) a, 26/35 of the Arms Act.

It is alleged that on secret information search was made by the police and petitioner along with others were apprehended and from the possession of the petitioner one mobile phone was recovered.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the petitioner has been falsely implicated in this case. The petitioner is in custody since 25.08.2020.

Considering the fact that the petitioner has got no criminal antecedent and only mobile phone was recovered from his possession, the petitioner, named above, is directed to be

Patna High Court CR. MISC. No.38744 of 2020(2) dt.09-02-2021 2/2 released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwer P.S. Case No. 352 of 2020 subject to the condition that the petitioner shall deposit Rs.10,000/- (Ten thousand) cash in the court below and the same shall abide by the final outcome in the trial i.e. if the petitioner is acquitted the amount of Rs.10,000/- shall be refunded in favour of the petitioner, otherwise it shall be forfeited.
