ANJANA MISHRA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehending his arrest in connection with Jalalgarh P.S. Case No. 105 of 2015 registered for the offences punishable under Sections 270, 271 and 273 of the Indian Penal Code and Section 47(a) of the Excise Act. Considering the fact that the case of recovery under Section 47(a) of the Excise Act involves a period prior to the promulgation of new excise policy and petitioner is having no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.32523 of 2016 (2) dt.11-08-2016 2/2 each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Jalalgarh P.S. Case No. 105 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
