2. The petitioners have preferred this application for grant of regular bail in connection with Sheikhpura Cyber P.S. Case No. 05 of 2025 dated 30.03.2025 registered for the offences punishable u/ss 303(2), 318(4), 319(2) read with Section 3(5) of the B.N.S. and Sections 66C and 66D of the I.T. Act.
3. As per the prosecution case, the informant received a list of 38 suspected mobile numbers from Economic Offence Unit, Bihar, Patna which are involved in cyber crime. On 29.03.2025, one of the mobile numbers i.e. 9903864379 was

No.41810 of 2025(2) dt.15-07-2025 2/3 found active near the village Pachna thereafter a team was constituted and he along with the other police personnel proceeded for verification and reached near the High School, Pachna. On seeing the police party, three persons started to flee away but they were apprehended by police and they disclosed their names as Shailesh Kumar @ Verma (petitioner no.1), Vikash Kumar (petitioner no. 2) and Umesh Kumar. On search, two mobile phones each were recovered from the possession of the petitioners. One mobile phone was also recovered from the co-accused, Umesh Kumar. It is further alleged that the petitioners are involved in the cyber crime.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have been made accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged mobile phones and they have no committed any fraud with any persons. The The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 30.03.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheikhpura in connection with Sheikhpura Cyber P.S. Case No. 05 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
