The petitioner has renewed his prayer for bail in a case registered under sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 20 litres of liquor was recovered from the motorcycle being driven by this petitioner. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 23.2.2022 (Annexure-1) passed in Cr. Misc. no. 49839 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 8.7.2021.

Heard learned APP for the State.

No.42583 of 2022(2) dt.14-09-2022 2/2 Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, the liberty granted to the petitioner in the earlier order of rejection dated 23.2.2022 and the petitioner having remained in custody for more than 1 year since 8.7.2021, the petitioner is directed to be enlarged on bail in connection with Govindpur P.S. Case no. 160 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Nawada.
