2. The petitioner has preferred this application for grant of regular bail in connection with Triveniganj P.S. Case No. 454 of 2023 dated 20.11.2023 registered for the offences punishable u/s 370(A), 376, 506 of the I.P.C. and Section 3,4,5 of Immoral Traffic Prevention Act and Section 04/06 of the POCSO Act, later on the learned special court framed charged under sections 370, 370A, 120B, 376, 376D, 506/34 of the I.P.C and u/s 3,4, 5 of the Immoral Traffic Prevention Act and u/s 04/ 06 of the POCSO Act.
3. As per the prosecution case, on 20.11.2023 the informant (Dharamveer Kumar Sathi, Addl. S.H.O. P.S.
Patna High Court CR. MISC. No.47049 of 2024(2) dt.25-07-2024 2/3 Triveniganj, Saupal) received information, that accused Panchanand Yadav along with his second wife Nagi @ Naginiya and some other females were running their business of prostitution in their old Cinema Hall. Thereafter, a raid was conducted in the cinema hall, the entire Cinema Hall was searched, Police recovered used condoms and mobile phones of the victim and prepared the seizure list accordingly.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a lady. The name of the petitioner has sprung up in the confessional statement of the co-accused Panchanand Yadav. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 10.05.2024 passed in Cr. Misc. No. 21907 of 2024. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.11.2023.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.47049 of 2024(2) dt.25-07-2024 3/3 of the case, the nature of allegation levelled against the petitioner and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul, in connection with Triveniganj P.S. Case No. 454 of 2023.
7. The application stands allowed.
