JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is accused in connection with Guraru P.S. Case No. 84 of 2016 for the offences under Sections 409 and 420 of the Indian Penal Code.
From perusal of the FIR it appears that the petitioner has been made accused in this case allegedly for non-handing over of the documents relating to appointment of Panchayat Teacher of Barorat Gram Panchayat.
The petitioner has highlighted that he has handed over the other documents and the document relating to appointment of Panchayat Teacher were lying with the Mukhiya who happens to be the in-charge of the appointment. Having regard to the fact that the alleged lapse of the
Patna High Court Cr.Misc. No.37958 of 2017 (2) dt.19-08-2017 2/2 petitioner can be dealt with in departmental proceeding which has not been initiated against the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-V, Gaya or the successor Court in connection with Guraru P.S. Case No. 84 of 2016, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
