Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Laheri P.S. Case No. 170 of 2021 registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code.

At the very outset, learned counsel for the petitioners submits that the present application has become infructuous as the Petitioner No. 2 (Ram Narayan Singh) has been arrested

Patna High Court CR. MISC. No.51556 of 2021(3) dt.22-03-2022 2/2 and seeks permission to withdraw the same.

It is, thus, dismissed as withdrawn as having become infructuous against petitioner No. 2.

Petitioner No. 1 is mother-in-law of the deceased aged about 69 years and the marriage is 15 years old. Considering the age of the petitioner No. 1 and the fact that there is no chance of her absconding, the present anticipatory bail application is allowed.

Accordingly, let the petitioner No. 1 above named be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 170 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) Saif/- U T
