The petitioner apprehend his arrest in connection with Turkaulia (Banjaria) P.S. Case No. 57 of 2015 registered under Section 47(A) of the Excise Act pending in the court of Chief Judicial Magistrate, Motihari, East Champaran. The accusation is of recovery of 22 litres country made liquor contained in plastic Jerkin and 8 litres country made liquor contained in Pepsi bottle from the house of the petitioner. Having considered the facts and circumstances of the case and the quantity of seized liquor, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the

Patna High Court Cr.Misc. No.50637 of 2015 (3) dt.10-12-2015 petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
