This is an application for bail in connection with Kamtaul P.S.Case No. 66 of 2017 registered for the offences punishable under Section 363, 366A/34 of the Indian Penal Code and 4/8 of POCSO Act.

Allegation against the petitioner and co-accused is of forcibly kidnapping the daughter of the informant. Submission of learned counsel for the petitioner is that in her statement under Section 164 Cr.P.C. the victim girl has stated that the petitioner and Reyaz have kidnapped her and her statement further shows that she married Reyaz and is living happily with him. Further submission is that he is in custody for four months.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Darbhanga, in connection with Kamtaul P.S.Case No. 66 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled.
