The petitioner seeks bail in Tajpur (Halai OP) P.S. Case No. 113 of 2021, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code. As per the prosecution case, this petitioner along with other co-accused persons killed the sister of informant due to non-fulfillment of demand of dowry.

It is submitted on behalf of the petitioner that petitioner is father-in-law of the deceased aged about 85 years and he is separate in mess and property. There is general and omnibus allegation. Husband of the deceased is already in custody. Petitioner is in custody since 12.03.2021 having no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.51370 of 2021(2) dt.29-11-2021 2/2 and the fact that petitioner is father-in-law of the deceased and there is general and omnibus allegation, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Samastipur in connection with Tajpur (Halai OP) P.S. Case No. 113 of 2021.
