JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 147, 323, 504, 506 of the Indian Penal Code and under section 27 of the Arms Act.
The prosecution case is that on 20.03.2015 at 8 P.M. while father of the informant was returning home from the agricultural field and when he reached near his house Bipin Yadav, petitioner No.1, pushed him. On protest being made by the father of informant, all the FIR named accused persons, including the petitioners, started firing. Though the firing made by the
Patna High Court Cr.Misc. No.28269 of 2016 (2) dt.14-07-2016 2/2 accused persons did not cause any injury.
It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general against several persons and there is counter version of the occurrence. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Naugachia in connection with Gopalpur (Rangra) P.S. Case No. 46 of 2015 (G.R. No. 254 of 2015) subject to the conditions as laid down under Section 438(2) Cr.P.C.
