JUSTICE S. KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Shikarpur P.S. Case No. 40 of 2017 registered for the offence punishable under Section 376(g) of the Indian Penal Code.

The allegation against the petitioner is that the informant was married with a person and she was not happy as she was being tortured and she fled away with the petitioner and the other accused person committed rape on her.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and the informant is major and has gone with the petitioner out of her

Patna High Court Cr.Misc. No.44972 of 2017 (2) dt.20-09-2017 sweet will and petitioner and the girl were caught by the police while they were moving at the plateform. It has further been submitted that similarly situated co-accused person, namely, Sadre Alam has already been granted bail by a Coordinate Bench of this Court vide order dated 28.07.2017 passed in Cr. Misc. No. 34583 of 2017. The petitioner is in custody since 30.01.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Shikarpur P.S. Case No. 40 of 2017.
