This is an application for bail in connection with Hawai Adda P.S.Case No. 90 of 2017 registered for the offences punishable under Sections 399, 402/34 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation against the petitioner is of recovery of loaded pistol from his possession and it further appears that earlier he was made accused in three other cases.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, which will appear from the fact that in the FIR it is alleged that petitioner was arrested near Airport, whereas in paragraph-18 of the case diary it appears that he was arrested from the house and so far other cases are

Patna High Court Cr.Misc. No.44468 of 2017 (3) dt.10-10-2017 2/2 concerned, he is on bail in those cases.

Heard learned APP also.

Having heard both sides and in the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it preferably within a period of six months. At the same time, SSP, Patna is directed to ensure the presence of the witnesses in court so that the trial be concluded within the period specified above.
