JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 354B, 323 and 379/34 of the Indian Penal Code.

The basic accusation is of torture. It is alleged against the petitioner that on 27.05.2015 in absence of the husband of the informant, he tried to outrage the modesty of the informant. It is submitted by learned counsel for the petitioner that for the occurrence of 27.05.2015, the FIR was registered on 15.06.2015. Though, the brother of the petitioner Md. Nurej lodged a case against the informant and others levelling accusation under Sections 341, 323 and 504/34 of the IPC.

No.45948 of 2015 (2) dt.29-09-2015 2/2 Considering the delayed lodging of the case and strained relationship between the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhagalpur in connection with Sultanganj P.S. Case No. 132 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
