Mr. MRITUNJAY KUMAR NIRALA ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 21-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 90 litres of country made liquor were recovered from the possession of the petitioners. It is further contended that petitioner no.2 is having clean antecedent, whereas, petitioner no.1 is involved in a case registered under Section 304B, 201, 120(B) and 34 of the Indian Penal Code but later on charge-sheet was submitted under

Patna High Court Cr.Misc. No.46780 of 2017(2) dt.21-09-2017 2/2 Section 498(A) of the Indian Penal Code. Petitioners are in custody since 26.07.2017.

Having regard to the facts and the circumstances of the case, the abovenamed petitioners are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Addl. District & Sessions Judge-II, Gopalganj in connection with Gopalganj (Town) P.S. Case No.321/17.

Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
